TERMS OF USE AND SALE FOR POSTHALLEN 

1.   ABOUT US AND THE SERVICE 

Posthallen Drinkhub AS, company registration number 929 170 113, with Prinsens gate 8, 0152 Oslo, as postal address (”Posthallen” ”we” or ”us”), offers a service for ordering and payment of goods and services at our (the ”Service”). The Service is available at our premises for our guests, via QR code and webpage.

In the Service, you as a customer can choose between different goods from our selection of different bars and restaurants. You can also choose between picking up the goods yourself or having the goods delivered to your table. In order to deliver the goods, name, telephone number and table number must be provided.

The Service consists of different third-party services. The SMS service provided by Sveve AS is used to send you a SMS about your order. The Service is also integrated with the third-party service Nets Easy, provided by Nets Denmark A/S. In Nets Easy, you can choose between various payment solutions such as Vipps and Apple Pay. In order to send you a receipt of your order, the Amazon Simple Email Service by Amazon Inc is used. Separate user terms apply to these third-party services. We recommend that you familiarize yourself with these third-party terms and conditions. Their terms regulate use, deviations and privacy.

 

To use the Service, you must be at least 18 years and have legal capacity. By placing an order, you accept these terms of use and sale ("Agreement"). You acknowledge that you meet the conditions for using the Service and understand that breach of the Agreement may result in restrictions, sanctions and exclusion from the Service.

2.   ORDERS AND CANCELLATIONS OF FOOD AND DRINKS 

Through the Service, you choose which food and/or drink and from which bar or restaurant you wish to order goods from, according to the options available at any time in the Service.

If one or more items in your order are sold out or other problems should arise which mean that the ordered items cannot be delivered, Posthallen reserves the right to cancel your order or parts of it. You will then be credited or receive a refund for your order.

Posthallen can make changes to the products and menus at any time, and reserves the right to replace suppliers.

3.   RIGHT OF CANCELLATION

Consumers have a 14-day right of cancellation for the purchase of goods and services according to the Cancellation Act. The rules for the right of cancellation vary depending on the goods and services ordered.

Certain goods and services are exempt from the right of cancellation. Food and drink delivered through the Service have a short shelf life, and should be consumed on the same day as delivered. You therefore cannot cancel orders for food and drink, as long as an order has been placed, cf. section 22 of the Cancellation Act.

If you have the right to cancel ordered goods or services, you must notify us in an unequivocal manner via email to tomas@posthallen.no. A standardized form can be used to assert your right of withdrawal, which is available here, but this is not mandatory.

 

By exercising your right of cancellation, you are solely responsible for any return costs. In addition, you are responsible for the condition of the goods from the time you received the goods and during the return. The item must be returned within 14 days of the notice being sent. Returns are made to the relevant supplier's point of sale. Goods that are returned must be packed in an appropriate way, be in good condition and, if applicable, in the original packaging.

You will receive a refund for canceled purchases of goods without undue delay and in all cases no later than 14 days after the day we receive your notification. We make repayments using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise with us.

Posthallen can cancel an order and return the money for the product if the order cannot be delivered. The amount is refunded through the payment service to Nets.

4.   PRICES AND PAYMENT 

All prices stated for goods and services include VAT. and include all additional costs. When delivering goods, delivery costs are also incurred. The customer can also choose to add a tip to the order. The price shown is the total price you will pay.

Payment through the Service is made by card via Nets Easy and the selected payment method. The amount to be paid is deducted from the account on the same day as delivery.

5.   RISK FOR GOODS AND UNCOLLECTED GOODS

The risk for ordered goods passes on to you when the goods have been taken over by you. If the delivery time has arrived and you fail to collect an item that has been placed at your disposal, you still have the risk of loss or damage due to the characteristics of the item itself.

Posthallen is not responsible for deteriorated or reduced quality and/or durability of goods that are not received by the original ordered delivery time.

Any complaints must be made in writing within a reasonable time from when the incident was discovered or should have been discovered. Complaints can be made no later than two years after you, as the buyer, took possession of the item.

In case of technical problems, the operating supplier The Facility App AS can be contacted by email at contact@thefacilityapp.no.

If you experience problems with third-party services, the third-party provider's own terms and conditions apply. Posthallen will be able to help you handle complaints against the third-party supplier. Complaints regarding these services can also be addressed directly to the third-party provider.

7.   INTELLECTUAL PROPERTY RIGHTS 

You understand that you only have a limited and non-exclusive right to use the Service and the content available in the Service. You undertake to respect all copyrights and intellectual property rights to and associated with the Service, including the rights of third parties.

8.  THE USERS OBLIGATIONS

As a user of the Service, you are bound by these terms. You are responsible for your use of the Service. The Service must not be used in violation of this Agreement, for other purposes, in violation of law, regulations or orders from authorities or in such a way that may harm others.

It is not permitted to sell, resell, rent or lease the Service, disrupt or prevent the functionality of the Service, upload content that contains viruses or other content that may damage the Service, attempt to gain unauthorized access to the Service, carry out reverse development of the Service, use The Service for commercial purposes or to develop a competitive service, or copy the Service or the Service's content, which is copyrighted material.

You understand that use of the Service in violation of the Agreement may lead to exclusion from the Service.

9.  THE RESPONSIBILITY OF POSTHALLEN

Posthallen's responsibility under this Agreement is, to the extent permitted by law, limited to the delivery of the Service and the services and goods ordered in the Service.

Posthallen is in no way responsible for third-party providers and their services, which are available in the Service. Third-party suppliers are independent legal entities and responsible for their own services and for complying with applicable laws and regulations.

Posthallen is not responsible for indirect losses such as loss of data. Any claim against Posthallen is limited to direct and documented losses and cannot exceed the amount you have paid to us in the last 12 months.

10.  PROCESSING OF PERSONAL DATA

11.  GOVERNING LAW, JURISDICTION AND CONSUMER CASES

The agreement is governed by Norwegian law. In the event of unresolved disputes, the dispute shall be resolved before Norwegian courts. The Oslo district court is the exclusive venue.
